Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Dott iOS app (the "App") operated by Dott Technologies ("us", "we", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.
User Content is defined by video, pictures or audio that was uploaded into the Dott app. This does not include text, audio or any additional features that were added to the uploaded content after it was in the app. This does not include content that was created by the app.
1. Eligibility
You must be at least 13 years of age to use our App. By accessing or using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.
2. Accounts
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and you agree to accept responsibility for all activities that occur under your account.
You agree to provide accurate, current, and complete information when creating an account and to update your account information as necessary to keep it accurate, current, and complete.
We reserve the right to suspend or terminate your account at any time for any reason, including if we believe that you have violated these Terms.
3. Intellectual Property
All content, features, and functionality available on or through the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and the overall "look and feel" of the App, are the property of Dott Technologies or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without our prior written consent.
4. Restrictions on Use
You agree not to use the App in any way that:
a. Violates any applicable federal, state, local, or international law or regulation.
b. Infringes upon the rights of others, including but not limited to intellectual property rights.
c. Harasses, abuses, defames, threatens, or otherwise infringes on the rights of any other person.
d. Interferes with or disrupts the operation of the App or the servers or networks connected to the App.
e. Attempts to gain unauthorized access to the App, other accounts, or any computer systems or networks connected to the App.
5. Termination
We reserve the right to terminate your access to and use of the App, without notice, for any reason, including but not limited to your violation of these Terms.
6. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no warranty that the App will meet your requirements, be uninterrupted, timely, secure, or error-free.
7. Limitation of Liability
To the fullest extent permitted by law, in no event shall Dott Technologies or its affiliates, officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, resulting from (a) your access to or use of the App; (b) your inability to access or use the App; (c) any conduct or content of
8. Termination of the App
Termination of the App: In the event of termination, discontinuation, or cessation of the App for any reason, Dott Technologies will take commercially reasonable steps to notify you in advance and provide you with an opportunity to download or retrieve your User Content within a specified time frame. Upon the expiration of this time frame, Dott Technologies reserves the right to delete or dispose of any remaining User Content, and we will have no further obligation to maintain, store, or provide access to such User Content.
Please note that the termination of the App does not affect the license granted by you to Dott Technologies with respect to your User Content. The license shall continue in perpetuity, subject to your right to terminate the license by providing written notice to Dott Technologies and removing your User Content from the App prior to its termination.
9. Fair Usage & Storage
While we proudly offer our users unlimited storage for their cherished memories and experiences on Dott, we must also ensure a reliable and seamless service for everyone. Therefore, we have established a fair usage policy:
- Fair Usage Limit: Users are entitled to up to 20GB of free storage space. We believe this is more than sufficient for the vast majority of our users to enjoy the full value and intended functionality of Dott.
- Additional Charges: If a user exceeds the 20GB limit, Dott reserves the right to apply additional charges for any storage used beyond this threshold.
- Service Reliability: Users who exceed the 20GB limit may experience varying degrees of service reliability. This can include, but is not limited to, slower speeds, limited functionality, and overall reduced performance.
- Communication: In the event a user's storage exceeds 20GB and Dott decides to take action by increasing their subscription, we will notify them and provide options for upgrading their storage plan to ensure continued access to our services without disruption.
We are confident that 20GB is more than adequate for our users to fully utilize Dott and appreciate its intended value. This policy allows us to maintain a high standard of service quality and ensure a positive experience for all users.
10. Changes to Terms
We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of the App shall be brought exclusively in the state of Illinois, and you hereby consent to the jurisdiction and venue of such courts.
